The Highways Act 1980 is very clear. A gate, door, or bar on private property that opens onto a street or highway must be installed in a way that it does not open outwards unless the local authority and the highway authority give their consent to do so. Therefore, if you install a gate that opens outward onto a street or highway, and you do not obtain the necessary consent from the local authority and highway authority, then you may be issued with a notice requiring you to alter the gate so that it does not open outwards. If you fail to comply with the notice within eight days, you will be guilty of an offence and liable to pay a fine.

Of course, if your gate opens out onto a private pavement and not a highway, then the legal requirement above does not apply. However, you should still think carefully about safety and consider how your gate opening could impact neighbours and pedestrians. If you are unsure whether your gate will open onto a highway or not, it’s always to speak to the relevant authority before installing a gate that opens outwards.

 

What gate is the next best solution?

The majority of driveways gates (especially for homes with short driveways) open inwards for this very reason, but there are plenty of alternatives.

Sliding Gates

Sliding gates are ideal if your driveway has enough space to accommodate them. They are opened and closed by an automated mechanism, which can be powered by either a motor or manual operation. The good thing about these gates is that they slide open horizontally, making it easy for pedestrians to walk around them and keeping the pavement free from obstruction.

Swing Gates (opening inwards)

For homes with limited space, swing gates are great so long as they open inwards. However, you will likely require ample space between the gate and any walls, fences, vehicles or other obstructions in order for them to open fully.

Bi-folding gates

These gates are thoughtfully designed for situations where there is not enough room for a sliding gate. They fold inwards like a concertina and can be made to fit any size opening. They are typically manually operated by a small pull handle, so they may not be ideal for larger driveways requiring fast access.
